- Restriction: Movement Control Order
- Announcement: March 16, 2020 10:00pm by Muhyiddin Yassin, Prime Minister of Malaysia
- Duration: March 18-31, 2020
- Affected: entire Malaysia
- Summary: Restricted movement, travel and no public assembly. All government and business premises to close except for essential goods and services.
- Ordinance: Prevention and Control of Infectious Diseases 1988 (Akta Pencegahan dan Pengawalan Penyakit Berjangkit 1988) and Police Act 1967 (Akta Polis 1967).
- Reason: Malaysia has faced a rapid increase in Covid-19 cases. Malaysia’s government views the situation seriously especially the 2nd wave. The priority of the government at this time is to prevent the virus from spreading (aka flattening the curve).
- Assurances: Supply of food, daily necessities and healthcare is sufficient with Ministry of Domestic Trade and Consumer Affairs to continuously monitor the situation of food supply and daily needs in the market.

Restricted Movement Key Points
- No mass movement and no public assembly including religious, sports, social and cultural activities. All religious organisations and business premises to be closed except for supermarkets, public markets, convenience stores, and grocery stores selling essentials.
- No overseas travel for Malaysians. 14-days self quarantine and health check required for returning travelers.
- No tourists and foreign visitors into Malaysia.
- Closure of all kindergartens, daycare, schools and educational institutions.
- Closure of all institutes of higher learning and technical schools.
- Closure of all government and companies except for essential services.

Employee Guidelines Related to Covid-19
Employers must provide sick/hospitalization leave for employees infected with Covid-19.
Employee sick leave (without hospitalization):
- Employees working <2 years: 14 days minimum
- Employees working 2 – 5 years: 18 days minimum
- Employees working >5 years: 22 days minimum
Employers are encouraged to pay employees on quarantine without any remaining sick/hospitalization leave days.
Employees on self-quarantine cannot be forced to utilize annual leave.
Employees without official quarantine/home surveillance cannot be prevented from turning up for work. However, employees who are sick can be requested to not go to work and given sick leave.
Employers can take the following steps to prevent laying off employees:-
- Reduce overtime work
- Reduce working days
- Reduce working hours
- Temporary layoff/shutdown with fair pay and alternate employment until operations resume
- Pay cut done in a fair and equitable manner as a final alternative after exhausting all other cost-cutting initiatives
Employer must inform Department of Labour of Peninsular Malaysia (JTKSM – Jabatan Tenaga Kerja Semenanjung Malaysia) at least 30 days before any of the following actions:-
- Retrenchment
- Voluntary separation
- Lay off
- Pay cut
FAQ
Q: What is a partial lockdown?
A: A partial lockdown is a restriction of movement including limiting movement, banning public gatherings, closing schools and universities, and restricting flights in/out. This is as opposed to a total lockdown (e.g. China, Italy) where people are not allowed to leave their homes.
Q: Are hotels closed?
A: Hotels are in the list of essential services. Existing stays can continue with room service. New hotel bookings are not allowed.
Q: Can I travel to a different state?
A: All interstate travel requires permission and special approval from the police department with a valid travel reason such as death of family member, critical illness of close relative, medical treatment or other situations which will be weighed by the police.
Q: Will Malaysians working in Singapore be able to travel across the causeway for work?
A: No as the border will be closed. Employees are to work with their employers which may include crossing the causeway to Singapore before March 18, 2020 12:00am.
Q: Will funerals and weddings be allowed?
A: Solemnisation of wedding allowed. Reception to be postponed. Simple funeral to be held. Attendance limited to immediate family.
Q: Will restaurants be open?
A: Yes restaurants will be open to cater for food delivery and takeaway but no dine-in allowed.
Q: Will Bursa Malaysia be open?
A: Yes Bursa Malaysia will open as usual.
Q: Will financial market intermediaries be open?
A: Financial market intermediaries are as per SC and BNM directive to be operating. This includes banks, financial institutions, and capital market intermediaries dealing in securities, fund management, and financial planning.
My husband company refuse to cancel their trainning whiv is lecture based. They arrange the trainning on alternate days for long hours and told the employers that they have consultef laaa lawyers. Is that okay. they reuse to do online trainning.
Do I need to pay my foreign and local employee during the lockdown?
I join a company on 2/3/20 as a senior manager with salary > RM10k . Under probation for 3 months.
I did not full salary for march 20 ( MCO peroid) as partial of it already get deducted as unpaid leave.
I foresee my april 20 ‘ salary 90% will get deducted as MCO extended till 28/4/20.

I’m a single mom have 1 daughters. I doing business at market (4pm until 9pm). Now during MCO all night business need to lock down. I really thankful our government to give us RM 500 for all “penjaja”. But during MCO extand until 28 April 2020, my daughter kindergarten request us to pay the school fees. During MCO kindergarten also lockdown why we still need to pay the school fees. We already no income how to pay?

Hi Loges, it will depend on the agreement that is in place with the day care. A force majeure provision (if any) excuses a party’s performance of its obligations under a contract when certain events beyond the control of the parties take place such as the current restricted movement order. Many nursery and day care have also implemented online classes.
My car is stuck in Honda Sungai Petani. But Honda has closed down till 31st of March. Isn’t workshop essential since Mechanics are Dr’s for vehicles? I think Government needs to make workshop, tire shops essential too! I need my car back urgently.

( our restaurant still open for take away and delivery, some of employee still working but some of us who stay far from restaurant choose to stay inside home for the safety and health , but the boss said no work no pay and ask us to get the voluntary unpaid leave)

Due to MCO, we are unable to use business premise rented. Does the rental still go on? Or can we seek pro-rated rent from landlords?
What about if contract staffs, staffs under probation and daily pay staffs, are them can get their full pay during the restriction movement order?
What if the employer forced the staffs to submit their daily time sheet for attendance. If yet to do so, it will consider as annual leave deduction or under unpaid leave?
Any idea if the official email from the employer to force us to do so?

why do we still need to pay full of school fee for private school without using the facilities of campus during MCO ? Only certain On line class r provided by school instead of full lesson but still need to pay those of miscellaneous and school fee . Hi good day, i have questions,
If management transfer staff to other outlet(telecommunication) from klia 2 to selayang outlet is it management have arranged the transportation or room for the staff.
Second question due to this lockdown covid 19 is it right a female staff who staying in Selangor Tanjung sepat have to travel daily 6days work 12hours (10am-10pm) by public transportation to Selayang one of outlet mall but the pay is still same as per in klia2 job.
Third question if there so transfer have plan for the staff in how many days it must be announced or give notice for the staff.
Fourth question what is the safety is company give if any wrong matter happen due the 2 and half hour journey per trip(going time only) since its female person.
Fifth question is that management can give 24hrs notice of transfer to the staff because it seems the want to cut staff in airport with threatening termination if the cannot make to new outlet after announced the transfer. Seems the staff have to travel 80km up n down.
Per day staff have to use rm110 bus ticket.

1. Do we need to continue paying school transport fees during MCO period, any supportive documents or statement from ministry or goverment?
2. Do we need to continue paying the monthly fees and the half year fees of kindergarten which are not operational during MCO but they are sending home works through watsapp once a month, no agreements we signed on payment condition pls advice as per goverment orders on this issue.
