Hi sir, I have bank owing of rm250k and decided to opt for bankruptcy. Lately I received a writ and Statement of claim from bank solicitor asking me to go court. Do I need to go if I really has no means to pay the debt and want to go for bankruptcy? Is it good to voluntarily declare bankrupt or wait till the bank taking actions sue me till the bankruptcy stage (understand it will take longer time compare to self declare bankrupt).

Hi Chiengching, it may be good to work out if any alternative arrangement (i.e. voluntary arrangement) can be made with the bank. If it’s a court hearing you will want to answer to the summons. A voluntary bankruptcy may be beneficial to trigger automatic stay whereby creditors are prevented from taking action to collect debts and repossessing property. Once a Receiving and Adjudication Order has been made, a person can no longer transfer any property (and any arrangements made to this effect are invalidated). And as soon as a person is declared bankrupt, the property shall be automatically vested upon the DGI. Do check with your legal counsel.
